Court Services
The Superior Court refers criminal cases to the Probation Department to prepare comprehensive reports with recommendations to the Court for sentencing. A summary of circumstances of the offense, social history, prior record, defendant’s statement, victim’s statement and restitution amounts are included in the report. Eligibility and suitability for probation supervision is addressed as well as specific conditions of probation supervision. Deputy Probation Officers are present at sentencing hearings and violation of probation hearings to provide the Court with objective information and to represent the Probation Department regarding the sentence for each case.
Adult Field Services
Deputy Probation Officers provide supervision of offenders, usually felons, who have been granted probation by the Court. Officers monitor probationer compliance with the terms and conditions of probation by conducting residence searches, drug testing, collecting restitution payments, referral and monitoring of counseling and treatment programs, and arresting probationers who are in violation of their probation. Officers investigate violations, initiate revocations and make recommendations for resentencing offenders.
Proposition 36
Proposition 36 was passed by California voters in November of 2000, and mandated probation and drug treatment in lieu of incarceration for specific non-violent drug offenses. These drug offenders are placed on formal probation and supervised and monitored at home, work and in treatment by the Deputy Probation Officers assigned to this caseload.
Courtesy Supervision
Interstate courtesy supervision requests are investigated and accepted/denied pursuant to the Interstate Compact Agreement. Courtesy supervision requests from within California are accepted and classified according to local procedure and California State Law.
Electronic Monitoring Program (EMP)
The County of El Dorado Board of Supervisors have authorized the Chief Probation Officer to offer EMP services to minimum security inmates and low risk offenders who may voluntarily participate in this home detention program during their Court imposed sentences in lieu of confinement in the County jail facilities. Deputy Probation Officers conduct assessments of program applicants for appropriate placement in the program and direct and supervise their continuous detention within the home. EMP enhances community safety by providing a supervised alternative to incarceration for adult inmates, assisting the Sheriff’s Department by safely decreasing overpopulation of the jail facilities. Offenders are supervised by random direct contact supplemented by the use of electronic monitoring surveillance equipment secured to their ankle. Offenders, assisted with rehabilitation services during the program, are provided the opportunity to be contributing community members, while paying restitution to victims and repaying a portion of the cost of the EMP program. Offenders who violate the conditions of EMP are arrested and returned to jail custody.
