General Information - Claim for Excess Proceeds

If you are a party of interest, you may be eligible to file for excess proceeds on the sale of tax defaulted property pursuant to §4675 of the California Revenue and Taxation Code. Parties of interest and their order of priority are:

1) First, lienholders of record prior to the recordation of the tax deed to the purchaser in the order of their priority; and

2) Then, any person with title of record to all or any portion of the property prior to the recordation of the tax deed to the purchaser.

You may use the attached form to assist in filing a claim. Return the original claim form along with copies of any documents supporting your claim. Please review El Dorado County Resolution 342-2003 for important and specific information related to filing a claim, documentation required, and time lines. This Resolution can be viewed at the following website:

   www.edcgov.us/auditor-controller/PropTax/pt_TaxSale_ExcessProceeds.html

or may be obtained by sending a request for a copy of the Resolution with a self-addressed, stamped envelope to the Auditor-Controller at the address below.

PLEASE NOTE: In order to receive consideration by the County Board of Supervisors, claims must be filed ON OR BEFORE THE EXPIRATION OF ONE YEAR following the date of the recording of the tax deed to the purchaser and will not be processed until one year has passed from that date. The Auditor-Controller will submit a recommendation to the Board of Supervisors regarding the disposition of your claim. The Auditor-Controller will issue a warrant for payment of approved claims no sooner than 90 days after the Board’s action.
